Sleeping monsters are not affected by this until they wake up. Characters with high magic resistance may negate the effect entirely. Its spellpower doesn't depend on the attacker's HD. It is always 125 (78 after stepdown). Characters with at least 178 MR are immune to this enchantment.
Reading a potion of cancellation will cancel this status effect.
You may also acquire the Mark condition by stepping on an alarm trap. This effect ignores your magic resistance.
